Dailey plans for guilty plea



Date for plea still to be determined

Joel F. Dailey plans to plead guilty to two drunken driving charges that caused the death of one Incline Village resident said Elliot Sattler, the Washoe County assistant district attorney prosecuting the case.

Dailey, a 39 year-old South Lake Tahoe man waived his right to a preliminary hearing Monday at Sparks Justice Court, choosing instead to plead guilty to two felonies, DUI causing death and DUI causing great bodily harm resulting from a Nov. 4, 2007 incident in Incline Village.

Dailey hit an Incline couple that morning when Maribel Oroxom, 29, and Rudy Diaz, 30, were crossing Northwood Boulevard at the intersection of State Highway 28.

The accident caused the death of Oroxom, mother of two, and badly injured Diaz. Both were illegal immigrants from Guatemala.

Oroxom’s body was flown back to her native Guatemala and Diaz spent more than a month at Renown Health Care in Reno before being released in December after suffering a closed-head injury in the collision.

Diaz now lives with family in Incline, who say due to his injuries probably cannot work again.

Sattler said a date for Dailey to enter his guilty plea and receive his sentence has not yet been determined, but expects it to be scheduled early next week.
