BROCKWAY, Calif. — After hearing complaints from community members for almost a decade, the California State Lands Commission will vote Thursday on whether or not to take down a metal fence near Speedboat Beach.
The commission's last agenda item is to consider authorizing the removal of the fence and to possibly compensate the property owner for the value of the fence if it was lawfully constructed in the first place.
“The fence needs to come down,” said Curtis Fossom, chief counsel for the commission.
The property owner is listed as Marc P. Desautels. Calls placed to his attorney for comment were not returned by deadline. Speedboat Beach also is known as Bucks Beach.
The State Lands Commission is also investigating if the fence, which beach users have complained about for years, was constructed lawfully. So far, the Commission can find no evidence of permits issued by United States Army Corps of Engineers or California Fish and Game.
The commission is also investigating if the fence actually lies on state land, Fossom said.
